To curb indiscriminate land purchases by outsiders especially in Uttarakhand’s hilly districts, the Pushkar Singh Dhami-led cabinet has approved a stringent new land law. The new law replaces the provisions introduced by the Trivendra Singh Rawat government in 2018, which had brought significant changes to the state’s land policies. Here are the key provisions of the newly approved law.
1. Ban on Land Purchase by Outsiders
Non-residents will no longer be able to buy agricultural or horticultural land in 11 hill districts of Uttarakhand. Only Haridwar and Udham Singh Nagar are exempt from this restriction.
2. Consolidation and Settlement in the Hills
To prevent encroachment and ensure proper land use, the government will undertake consolidation and settlement in hilly areas.
3. Restricted Powers of District Magistrates
District Magistrates will no longer have the authority to personally approve land purchases. Instead, all transactions will be processed through a dedicated government portal.
4. Online Monitoring of Land Transactions
A new portal will be launched to track land purchases by non-residents, ensuring transparency and preventing fraud.
5. Mandatory Affidavit for Buyers
Individuals from outside the state must submit an affidavit before purchasing land to prevent irregularities and fraudulent transactions.
6. Regular Reporting of Land Transactions
District Magistrates will be required to submit periodic reports on land purchases to the Revenue Council and the state government.
7. Strict Land Use Regulations in Municipal Limits
Land within municipal areas can only be used according to its designated purpose. Any unauthorized use will result in the land being seized by the government.
The law will curb the unhindered acquisition of land by outsiders, ensuring better land availability for local residents. It will also stabilize land prices, making property more accessible for the people of Uttarakhand. Additionally, with the government gaining greater control over land transactions, fraudulent activities and irregularities in land deals will be minimized.
