While passing the important order, the High Court ordered to demolish illegal the construction in Rishikesh, on illegal occupation of the public land.
The Court has given a three-week notice to the builders for construction against the master plan and Haridwar Development Authority’s Building Bylaws, to respond to the request, then the orders are to demolish it. At the same time, the High Court has directed Haridwar Development Authority to seal the religious places developed illegally.
Anil Kumar Gupta, a resident of Rishikesh filed a public interest petition saying that the encroachment and illegal occupation have worsened the beauty of the place of pilgrimage. Government land has been occupied. Therefore, encroachment should be removed. The Bench of Acting Chief Justice Justice Rajiv Sharma and Justice Manoj Kumar Tiwari issued detailed guidelines and finalized the PIL.
The Bench, in particular, mentioned in 2011 the Supreme Court’s decision in the case of Jaspal Singh and others versus the government, said that regularization of the construction done even after illegal possession and heavy expenditure has not been justified.
Court has strict orders to remove encroachment from the pavement in Rishikesh. Simultaneously, the civil and revenue courts will have to remove the encroachment except for cases pending with the court.
