Fresh PIL Threatens Arvind Kejriwal’s CM Post amidst ED Custody

A new Public Interest Litigation (PIL) has been filed against AAP’s national convener Arvind Kejriwal. It has created a fresh doubt on his position as Delhi’s Chief Minister while he remains in ED custody. The Hindu Sena has filed the petition in the Delhi High Court for seeking Kejriwal’s removal from the CM post.

The PIL by the Hindu Sena urges the court to direct Delhi Lieutenant Governor VK Saxena to oust CM Arvind Kejriwal from his position. Applicant further suggested that the central government should govern Delhi through LG rule.

This comes after the Delhi High Court dismissed a previous PIL seeking Kejriwal’s removal as Chief Minister of the National Capital Territory (NCT) of Delhi. The court emphasized that there was limited scope for judicial intervention in such matters.

Despite being in custody, Kejriwal and AAP ministers maintain their stance that he will continue to lead the Delhi government. They even passed a public welfare order recently. The fresh PIL has been filed by Hindu Sena president Vishnu Gupta. He mentions that the Constitution did not anticipate a scenario where a CM could run the government from judicial or police custody.

“Indian Constitution Articles 163 & 164, defines the role of the Chief Minister as head of the Council of Ministers, to aid and advise the Governor in exercising his functions, except discretionary ones,” the plea stated.

The plea contends that since Kejriwal’s arrest on March 21, the functioning of Delhi’s government has deviated from the constitutional scheme.

In parallel, the Bharatiya Janata Party (BJP) has raised speculations about Sunita Kejriwal, Arvind Kejriwal’s wife, taking charge as the new Chief Minister of Delhi, especially after his remand was extended. Union minister Hardeep Singh Puri compared Sunita Kejriwal to former Bihar Chief Minister Rabri Devi, hinting at her readiness to assume her husband’s role.

“The lady you mentioned might be preparing to hold office similar to Rabri Devi in Bihar,” Puri remarked to reporters on Friday.

Earlier in the day, Sunita Kejriwal launched a WhatsApp campaign urging people to support her husband during this challenging time.
