In the matter of Article 35A of the Constitution giving definition of a special status to the citizens of Jammu and Kashmir and the permanent resident of the state, hearing in the Supreme Court on Monday has been postponed. CJI Deepak Mishra said that the third judge, DY Chandrachud, is not present today, hence the hearing on the case is deferred. The bench of three judges will decide whether this matter should be sent to the Constitution bench. Today, since only two judges were sitting in the court the hearing had to be postponed because the bench of three judges hears such cases.
The Jammu and Kashmir government, on the other hand, also urged to stop the proceedings. Keeping all these things in mind, the Supreme Court has deferred the case. The petitioners opposed the demand for the hearing of the Jammu and Kashmir government. The next hearing of the case will be on August 27. The Supreme Court will decide in the next hearing whether the matter should be sent to the Constitution bench.
