Are employees equal before Trivendra Singh Rawat govt ?

Additional Secretary Arjun Singh, who belongs to Secretariat Service Cadre (SSC), has been running between pillar to post but Secretariat Administration Department (SAD) has been denying his right for the last one year. Frustrated officer has approached to the High court, Nainital and HC has issued a direction to the competent authority but SAD has been delaying this with a note that the matter to be produced before cabinet. By saying this they have saved themselves from defamation of court. It has raised question mark that as post creation/upgradation comes under the jurisdiction of cabinet then how these four posts created/upgraded during previous regime ? Even if the decisions were wrong then why Trivendra Singh Rawat led BJP government keeping it alive ? Ironically Additional secretary’s rank officer is struggling hard to get his right so we can presume situation of the officer posted in remote areas.

Now question raises— Do we make service rule without creating post? If previous decision was approved by the cabinet, then why they are keeping the post alive? Does it mean all the posts, which were not created by cabinet, will be referred to cabinet?

It would be pertinent to mention here that On April 16, 2015 then two officers of Secretariat Service i.e. RS Lohani and Kishan nath were given grade pay of Rs 10,000. Then SAD had mentioned that two officers are being upgraded and with this upgradation Additional secretary rank post for SSC would confin within 09 only. On December 30, 2016 SAD had created two more post of Additional secretary from SSC. With this decision the number increased to 11.

Although the two officer have retired in 2016. With their retirement two posts of grade pay 10,000 lying vacant for the last one year but SAD is not upgrading SSC officers. Coincidentally two senior most officers Teekam Singh Panwar and Arjun Singh are waiting to get their dues but it has been getting delayed. Meanwhile Arjun Singh has challenged the SAD’s approach and court has issued direction too but yet to see progress. To escape from defamation on April 3, 2018 SAD has communicated to Arjun Singh that the matter comes under the jurisdiction of cabinet so they will put before cabinet.
